The allegations stem from an incident on November 9, where Fuscarino was reportedly recorded on security footage pulling a foster child from bed and striking him multiple times.

Garden State Equality issued a statement emphasizing their commitment to addressing allegations against staff seriously and opposing violence. Upon learning of the charges, the organization placed Fuscarino on leave.

Fuscarino's attorney characterized the incident as a 'difficult personal family moment,' asserting that it has been misrepresented in the media. He claimed that no physical harm was caused and that the situation should be viewed as a private matter rather than a public spectacle.

The New Jersey Division of Child Protection and Permanency obtained footage of the incident and subsequently notified the Monmouth County Prosecutor’s Office, leading to Fuscarino's arrest on November 21.
