Florida Governor Proposes AI Regulations Amid Rising Concerns

DeSantis asserted that an executive order signed by former President Donald Trump, which seeks to prevent states from establishing their own AI regulations, would not hinder Florida's regulatory efforts. He stated, "An executive order can’t block the states... Clearly we have the right to do this."
The governor's proposals follow alarming reports from parents regarding the negative impacts of unregulated AI. These include a child's suicide linked to interactions with a chatbot that claimed to be a licensed therapist, as well as another child's attempted suicide. The parents have initiated legal action against the AI company involved.
In response to these incidents, the Florida House of Representatives recently designated a week to discuss AI, during which lawmakers considered various legislative measures. One proposed bill would prevent insurance companies from relying solely on AI for claims decisions, ensuring that human oversight remains part of the process.
DeSantis also expressed a commitment to protecting utility customers from increased costs associated with the energy demands of large data centers, a concern raised by consumer advocates regarding recent rate hikes approved by the Public Service Commission.
Additional proposals from DeSantis include a requirement for consumers to be informed when they are interacting with AI, restrictions on the use of AI tools developed in China, and prohibitions against using AI for therapeutic purposes without human oversight.
The legal landscape surrounding state regulation of AI remains uncertain, particularly following Trump's executive order aimed at limiting state-level interventions. Critics argue that such federal actions may favor large AI corporations at the expense of consumer protection.
The testimonies from parents underscore the urgent need for regulatory measures. Megan Garcia recounted her son’s distressing interactions with a chatbot, which she claims failed to provide appropriate support when he expressed suicidal thoughts. Similarly, Mandi Furniss described the harmful influence of a chatbot on her son, who has since required mental health treatment.
Law enforcement officials have also raised concerns about the misuse of AI, particularly regarding the creation of deep fake images and the potential for AI to facilitate cybercrime. The rapid advancement of AI technology has prompted calls for immediate regulatory action to mitigate its risks, especially for vulnerable populations such as children.
DeSantis warned that without regulation, the aggressive pursuit of profit by AI companies could lead to further exploitation of young users, emphasizing the need for protective measures in the face of rapidly evolving technology.
